Land inheritance between Ottoman law and Islamic law

Until a certain date, the Land Department used to apply the Ottoman land law with regard to the passing of the estate from the deceased to the heirs whereby a female received a share equal to that of a male. The department later applied the Islamic land law whereby a male received twice the share of a female. Is it permissible for a woman to collect her share of inheritance in accordance with the Ottoman land law? And is it permissible for her to pay the expenses of the paperwork from the difference between her share according to the Ottoman land law and that according to the Islamic land law?

My father wrote a will for my mother to take all the inheritance after his death. Is this lawful?

Assalamu Alaikum,

Our father recently died and had written a will saying that everything should go to our mother if she were still alive when he died. His will also says that if she were not alive at the time of his death, then his property should be divided equally between his living children. Our mother is still alive at this time. He has four children, two male and two female all adults.

Should our mother inherit everything? If not, how should the inheritance be distributed at this time?

Jazakum Allah Khair

My father bought a house on my mother’s name before he died. My brothers forced my mum to sell the house and considered the money as inheritance. Is this permissible?

al salam alikom

My father died 16 years ago. He had a house when he bought it, he wrote it for my mother and she did not pay its price. Now my brothers forced her to sell it & want to have its price as inheritance from our father. Considering our mother not the owner as she did not pay its price. By the way they used violence with our mother to force her to buy it.

Is my abusive husband entitled to inherit my money after my death?

I was married to a man for 20+ years and had 2 children (now ages 26 and 21). I worked all my life and saved money for my children. I got divorced 5 years ago and re-married a man 10 years younger than me. He mistreats me and most of the time, no money/no job (bad choice). I spent a lot of my money on our living expenses. Since my marriage to him, he has contributed to less than 5-10% of expenses and I paid and continue to pay the other 90-95%. My understanding is that a woman's money earned from a job is hers and that if she "volunteers" to help with the living expenses, it's her choice and that it's not mandatory. In Islam, the woman's money can not be touched or demanded by the husband. Assuming this is true, and the fact that my current husband does not provide for me as he should according to Islamic law, when I die, does he inherit money I saved for my children during the 20 years I was not married to him? Does he have a right to any of my money when I die?

I have a disabled daughter. Can I write a will which grants her all my money after my death?

Al salam Alaykum,

I have one disabled daughter and I own an apartment in her name. She is my only child and she will not be able to work or provide for herself. She has uncles and aunts who are doing well financially. I want to make a will that will give her all what I own, including money and anything else I have just to make sure she will be able to have a good life after my death, and I already named a guardian to take care of her, Is that permissible? And where do I do that will? Can I do that in Al Azhar in my next visit to Cairo?

Thank You, Jazakom Allah Kheir

Can I receive inheritance from my non Muslim parents or can I receive the money as a gift in their lifetime?

I understand that because I am a Muslim that I may not inherit from my non Muslim parents. Does this also mean that I may not be given a gift of money or some possessions from my parents instead of being written into the will or trust agreement? And if I am allowed to receive a gift, is there any limit on the value of such a gift? Also, I imagine that I must inform my parents that I can not serve as a substitute trustee of their estate. Am I correct in that? The trust that they had written by their attorney does not follow the Islamic way of inheritance and involves investing the trust corpus in speculative investments. Also, if you can please briefly explain why Muslim children are not allowed to inherit from their non Muslim parents, I would appreciate to know that.

The ruling for a grandparent relinquishing his/her share in a son's estate in favor of grandchildren

My only son passed away in the blessed month of Ramadan. I do not have a husband or anyone to support me. I would like the legal opinion for the following:
1- Is it recommended for me to relinquish all or part of my legal share in my son's estate? Should such a relinquishment — whatever its percentage — be in favor of my son's wife or also in favor of my young grandchildren? What is the recommended percentage?
2- Since I do not have any children to inherit me, is it possible for me to leave a will in favor of my three young grandchildren (2 girls and 1 boy) to be implemented after my death? What is the permissible percentage that I may leave of what I own?
3- Apart from the will, is it possible for me at present to buy — without any limit to the amount — a property, shares or securities for my young grandchildren?
