The inheritance of a woman survived by a daughter, maternal siblings, and a paternal cousin

Question


A woman passed away, survived by a daughter, maternal siblings (two brothers and one sister) and a full paternal cousin. The deceased left no other heirs besides those mentioned above, nor any descendant entitled to a binding will. What is the share of each of the heirs?

Answer

Upon the death of the aforementioned woman, leaving only the heirs previously mentioned, her estate shall be distributed as follows:

  • The daughter receives half of the estate as an obligatory share (farḍ), due to being the sole daughter and the absence of any co-universal heir.
  • The full paternal cousin receives the remainder after the daughter’s share (half the estate) as a universal heir, due to the absence of another heir entitled to an obligatory share or a closer universal heir.
  • The maternal siblings receive nothing, as they are eliminated from inheritance by the presence of an inheriting descendant.
