Medical errors that harm patients

Question

The question concerns unintentional medical errors that result in delayed recovery, financial loss to the patient, disability, or even death, despite the physician acting solely in patient's best medical interests. But above every person of knowledge is one who is more knowledgeable. If a physician makes a medical error, how should they repent, given that it is difficult to find anyone who does not make errors?

Answer

A physician is entrusted with the lives and health of people. Their medical errors carry greater consequences than those of others. A physician should not undertake any case they are not competent to treat. If a physician makes a medical error, they must repent to Allah Almighty and strive not to repeat it.

Medical errors are of two kinds:

- An error that a physician of similar competence might make and that can hardly be avoided; such an error is excusable.

- A grave error resulting from a physician undertaking a case beyond their competence or from negligence in treating a case within their expertise. This matter is left to qualified experts and specialists to determine whether the physician incurs liability for the error.
