Financial entitlements paid by an employer after an employee’s death
Question
What is the ruling on the entitlements paid by an employer following an employee’s death? Following the death of my husband, his employer issued certain financial entitlements in my name alone, without listing any of the other heirs. Are these entitlements considered part of my husband’s estate?
Answer
Financial entitlements paid by the employer to the heirs, or to some of them, belong solely to those in whose name they are issued. They are a grant from the employer and not property belonging to the deceased. Accordingly, they do not constitute part of the deceased’s estate that must be distributed among the heirs in accordance with their prescribed shares.
