The waiting period of a woman who does not menstruate

Question

I divorced my English Muslim wife through a revocable divorce on 18

February 2006 and have not resumed marital relations with her

since. She is elderly and menopausal. What is the Islamic ruling

concerning our marital status?

Answer

If the case is as described in the question, the woman has been

irrevocably divorced by the inquirer with a minor divorce (baynunah

sughrah). The inquirer and his wife may not resume their marriage except through a new

marriage contract with her consent and approval, as the waiting

period (ʿiddah) of a woman who no longer menstruates is three

months, and this period has already elapsed.
