The waiting period of a woman before consummation of marriage

Question

Is a woman required to observe a waiting period if she is divorced before consummation of the marriage??

Answer

It is established in Islamic law that a woman who has been divorced before the consummation of marriage is not required to observe a post-divorce waiting period (‘iddah) due to the words of Allah Almighty, “O You who have believed, when you marry believing women and then divorce them before you have touched them, then there is not for you any waiting period to count concerning them” (Quran, 33: 49).

When a man divorces his wife before consummating the marriage, the divorce is considered irrevocable (talaq ba’in). Accordingly, the woman may marry another man immediately after the divorce without observing a waiting period. After such a divorce, the husband may only remarry her, with her permission and consent, with a new marriage contract and a new marriage payment (mahr), if it was the first or second pronouncement of divorce.
