Marriage to a brother’s divorcée

Question

What is the ruling on marriage to a brother’s divorced wife? A man divorced his wife, and his full brother wishes to marry her. Is this permissible under Islamic law?

Answer

It is established in Islamic law that, once a woman has been divorced and her waiting period is complete, it is permissible for her to marry someone other than her former husband. The waiting period is completed by experiencing three full menstrual cycles, if she menstruates; by giving birth, if she is pregnant; or by the passage of three months, if she does not menstruate due to age (either young or old).

Concerning the question, it is permissible for the woman’s former husband’s brother to marry her after her waiting period has ended in accordance to Islamic law, as there is no cause for prohibition.
