Paying zakat al-fitr after the Eid prayer or on the same day
Question
I was late in giving zakat al-fitr and only paid it after the Eid prayer. Is it considered a timely fulfillment or is it regarded as a make-up payment? Does it cease to be binding once the day of Eid has passed?
Answer
Zakat al-fitr is a financial obligation that becomes binding upon the legally accountable person. It does not cease to be binding once its time has passed, by analogy to a debt.
In Hanafi jurisprudence, if zakat al-fitr is not paid on the day of Eid, it is to be paid afterward and is considered to have been fulfilled on time because it is an obligation with an extended time frame. This is because, since its devotional purpose is rationally understood, its time is not precisely defined.[1] Ibn ʿAbbas (may Allah be pleased with them both) said, “The Messenger of Allah (peace and blessings be upon him and his family) prescribed zakat al-fitr as purification for the fasting person from idle talk and obscenity, and as food for the poor. Whoever pays it before the prayer, it is an accepted zakat and whoever discharges it after the prayer, it is regarded as a form of charity among other charitable acts” (recorded by Abu Dawud and Ibn Majah). This hadith does not indicate that paying the zakat after the Eid prayer is impermissible or outside its proper time frame. This is because the words ‘paid it’ occur twice in the hadith: once for paying it before the prayer and another for paying it after the prayer. This removes the ambiguity regarding the claim that paying it after the prayer constitutes making it up. The pronoun in ‘paid it’ in both instances refers to zakat al-fitr, which establishes the description of timely fulfillment even when it is discharged after the prayer, albeit with diminished reward such that it becomes like other voluntary charities. It is also possible that this wording reflects Ibn ʿAbbas’s own juristic interpretation and inference, since the narration in the Sunan does not explicitly state that the hadith is marfuʿ (directly attributed to the Prophet).[2]
Based on the above, if a Muslim delays paying zakat al-fitr until afterward the Eid prayer, it still fulfills the obligation; however, it is considered timely performance rather than a make-up payment.
