A son’s obligation to financially support his mother if he has sufficient means

Question

What is the ruling on a son’s obligation to financially support his mother if he is well-ff? I have a son who is about twelve years old and possesses considerable wealth. I was appointed as his guardian, but he has since been placed in the care of his paternal uncle. I am a poor woman who owns nothing, has no husband, and has no income or means of support. I want to use some of my son’s money to support myself, as I have no one to provide for me financially except my son, who is still a minor. Kindly, provide me with the ruling on my case. Is it permissible for me to take maintenance for myself from my son’s wealth?

Answer

If the case is as mentioned in the question, we advise that this woman is permitted to take from her son’s wealth what suffices for her needs. Al-Bahr (vol. 4, p. 233), quoting Al-Dakhirah, states that the maintenance of parents, children, and a wife is obligatory without the need for a court ruling. Therefore, if any of them have access to property of the kind needed for their maintenance, they may take what is due to them without a court ruling or the consent of the person who owns the wealth.

And Allah Almighty knows best.
