Can a non Muslim leave his wealth to a Muslim?

Salam alikom,

I have a quick question in regards to Muslims inheriting from non Muslims. As far as I know, Muslims cannot inherit from non Muslim parents, how about if a non Muslim unrelated person decided to leave their wealth to a Muslim person, is that allowed?

Answer

Honorable brother,

There is a difference between inheritance, disposal of one's property in lifetime and a bequest. As for inheritance, it is disallowed for a Muslim to inherit a non-Muslim and vice versa. As for disposal of one's property in lifetime, it is permissible for either a Muslim or non-Muslim to gift whatever he wishes from his own property in lifetime to whoever he wishes, whether or not a Muslim. A bequest means disposal of property after death, it must be carried out within the limits of one third of the property and the rest of it cannot be distributed without the consent of the other heirs excluding the minors.
