Conception through artificial insemination

Question

no. 2028 for the year 2005 which includes the following:
A woman wants to conceive through artificial insemination (AI). However, her husband refuses claiming that it contradicts the Shari'ah [Islamic law]. Please note that physicians think it is possible for her to conceive through this process.

Answer

It is obligatory to fulfill certain conditions and criteria in conducting artificial insemination, the most important of which are the following:

• The egg to be fertilized must be taken from the wife.
• The sperm sample must be taken from the husband.
• The fertilized egg must be implanted in the wife's uterus.

If any of the above conditions are not fulfilled, such as if the egg is from another woman, the sperm is from another man or the fertilized egg is implanted in another woman's womb, artificial insemination will be then unlawful [haram]. This is because it includes lineage confusion, disruption of legitimate rights, deviation from man's natural disposition and the like of other prohibited consequences.

The Ruling

Based on the above, there is no harm in conducting artificial insemination and it does not contradict the will of Allah Almighty.

Allah Almighty knows best.
