The inquirer purchased a property from his uncle for 270, 000 L.E. He made a down payment of 100, 000 L.E and the rest of the sum is paid in monthly installments of 10, 000 L.E. The remaining sum at the moment is 115, 000 L.E. The inquirer wishes to accompany his mother on hajj which will cost around 70, 000 L.E, noting that he has previously made hajj twice: last year on his own and four years ago with his mother. Because his uncle is retired and his pension is insufficient to meet his needs, he has asked for it on more than one occasion. Is it permissible for the inquirer to make hajj with his mother or should he give his uncle what he owes him?
Answer
If the case is as mentioned in the question, then settling a debt takes precedence over making a nonobligatory hajj, especially since the creditor is in need of this sum and has mentioned this to his nephew.
