My husband and I consummated our marriage before its due time as we only conducted our marriage officially and promised to wait for next year to celebrate our wedding.

I ve got married last month with a brother and everything el hamdulelah was clear as we have decided to celebrate our wedding next year Inshallah. So we made just a small dinner between our nearest familiars celebrating our Qiran. What happened is that as the first time that we ve got to be alone we couldn t control ourselves and we consummated our marriage right in the middle of the Kitchen. We ve been discovered by my mother who saw me bleeding (it was really a bad position and that caused me hemorrhage). You could imagine what happened next my parents threw out my husband and his family in Fajr time.

As much as he asked for forgiveness or tried to explain that it was his fault they didn t want to hear anything even I haven t been forced. He tried many days after that and there wasn t any way to convince them. They forced me to proceed with the divorce for the reason that he is a savage and there is no way to stay with him anymore. In case I choose him I ll be out home as well forgetting about them for ever. I am still shocked about it all together. From one side I ve got my husband who doesn t want separation or divorce. From the other side my parents put pressure on me to either obey them or leave home. I need to know what religion says in this situation.

I know that it wasn t the moment neither the place to do that... But couldn t stop him because I didn t imagine that we will go far like this. Help me to find a small light..Jazakum Allah Khayran.

We are now separated but I don't know if it was a real legal marriage. We went to the mosque and we talked to the Sheikh, he agreed to make our marriage without being a legal court marriage. He told me to repeat some things in Arabic, but I wanted to know what I was saying and I asked him to translate it. He refused to do it. We never had a paper saying that we were married, the sheikh only called two witnesses who were in the mosque, and that I didn’t know them. Now I would like to know if it was a legal Islamic marriage.

My father is adamant on postponing my marriage plans. What should I do?

I am a Muslim girl studying in a European country. A Muslim young man proposed to me and wanted to meet my family to get married. However, my father doesn't want to meet him right now and is postponing the meeting for half a year without any reason. When ever my nafs tries to over power me in regard to sexual desires, I supplicate and usually fast to keep myself away from doing anything that is not acceptable in Islam but some times I am unable to do so. Marriage by proxy

A woman was engaged to a person working overseas. When he wanted to conduct the marriage, he requested the name of one of her relatives and sent him an official power of attorney so that he would conduct the contract on his behalf. The marriage was conducted after the bride commissioned her maternal uncle to enact her marriage contract. When the marriage official went to register the contract, the court refused to notarize it because it was conducted by means of a general power of attorney, which is not valid for conducting a marriage contract. The marriage official asked the grantor to send a limited power of attorney specific to conducting a marriage contract or to come in person to conduct the marriage contract. The groom, however, refused to execute a limited power of attorney with the excuse that he does not have the time, and said he will return to effect the marriage himself. When he did return during his vacation, he did not go to the marriage official and kept postponing performing the contract in person and furnishing the marital house. Moreover, he went so far as to ask for his rights as a husband. When the bride requested that they separate amicably, he replied that he would leave her without a divorce, and then traveled.
Is she a wife to this man, or is the marriage not even valid—especially since she does not have a legal marriage document or anything else to prove that she is his wife?

My husband abandoned me and sees another woman and he does not support his kids financially. Please tell me what to do?

I am married to a man for five years now and I have three girls. My husband left us for five months now and I am totally alone with the kids with no financial support from him. When he came home he said he had financial problems and that his work is not stable but I discovered later that he was lying to me and that he was seeing another woman. I saw their pictures together and I went crazy and threatened him that I will file for divorce. He said that he does not want to lose me or the kids and he does not want to divorce me. So I asked him to leave this woman he is seeing and to my shock he said that he married her but illegally with no contract because he is not allowed to have officially two wives.

He begged me to reconsider for the sake of the kids and after few days I changed my opinion and decided to try again because of the girls love him so much and I still love him but things did not change at all. He also said that I should try to change myself and lose weight to please him. But he went away again with no prior note and kept on not spending on us and at the same time he bought an expensive house for him and his new woman and gives her valuable gifts. My older girl- 5 years old- is very attached to her dad and every time he comes over for a little while, she screams her lungs out when he leaves and she started to pee on herself and became aggressive as a reaction to the fact that she misses him.

All his friends advise him to take care of his family and leave the woman he is seeing but he does not listen at all. Please advise me what to do. I feel that I can’t think straight any more. I really appreciate your help.

I am in love with a non Muslim man. I am torn apart, what can I do?

I converted to Islam in August 2012, alhamdulillah, but before that I was dating a man. We are still dating and he is not a Muslim. A husband preventing his wife from visiting her family

My daughter, who is an engineer, got married over a year ago. Since then her
husband has prevented her from visiting both her immediate and extended families and her friends and even isolated her from the outside world to the extent that he prevents her from answering our calls. In the few instances when we communicated with her, he would be at the other end of the line, overhearing our conversations or even recording them as he maintains. He refuses to allow anyone from her family to visit or even phone her.

I am a married with two sons. My husband converted to the Ahmadiyya sect which was founded in Qadyan, India. Their founder was Mirza Ghulam Ahmed Qadyan.

I learnt that [sometime after the death of its founder] this sect was split into the Ahmadiyya and the extremist Qadianiyya sects. The Muslim community and religious scholars unanimously agree that followers of the Qadianiyya are disbelievers due to their strange beliefs (they make their pilgrimage to Qadyan, pray facing Qadyan, and so forth).

I also learnt that the beliefs of the Ahmadiyya do not differ from ours. They pray facing Mecca, read the Qur`an, adhere to the sunna of prophet Mohammed [pbuh], and testify that there is no God but Allah and that Mohammed is His messenger. The only differences are: they do not pray in sunni mosques, they pray behind an imam from their own sect, they have a different viewpoint on the death of prophet 'Isa [pbuh] from ours, and that Ghulam Ahmed, the imam of the Ahmadiyya sect, is the Anticipated Mahdy resembling 'Isa. I read their pledge of allegiance and found that it contained the two testimonies of faith, the sunna of prophet Mohammed [pbuh], and the five pillars of Islam.

Questions

- What is the ruling for being married to a man who adheres to this sect?
- Is it permissible to remain married to him? If not, is it permissible for my husband to continue supporting me and my children and provide lodgings for us ?
- Is it permissible for him to take my sons after they reach the legal age when they must be in the custody of their father?

I married a 37 year old Emirati woman who was previously married. The marriage contract was conducted at the lawyer's office in the presence of witnesses. It included the payment of a dowry and met the rest of the conditions. The bride's wali did not consent to the marriage because of my different nationality. After we concluded the marriage contract, I filed a signature verification lawsuit and the court issued its decision [in my favor]. I then notarized the court verdict at the Ministry of Justice, the Ministry of Foreign Affairs and the UAE embassy. Afterwards, I publicized the marriage to everyone even to my wife's family. However, her father resorted to the courts in the United Arab Emirates claiming the illegitimacy of the marriage because the contract did not fulfill the condition of the presence of the bride's wali. Is the marriage lawful? What is the stance of Islamic law on this?

Marriage of the mentally retarded

We reviewed request no. 586 for the year 2005 which includes the following:

    Some families of individuals with a mild form of retardation want them to get married. These individuals can be self dependent in their private affairs such as personal hygiene, eating, and performing some simple tasks. It is also possible to train them to perform simple handiwork and crafts which do not require mental effort as their mental age is always lower than their actual age. Their families have the following concerns:

  1. They fear that their sons will reproduce mentally retarded offspring due to genetic factors.
  2. Some guardians refuse to marry their daughters to mentally retarded individuals. For this reason, wealthy families with mentally retarded sons turn to poor families who, in some instances, consent to the marriage.

The questions are:

  1. Does a mentally retarded person –whose handicap is mild—have the right to marry if his family can financially support him and his wife or if he has an inheritance?
  2. If genetic testing and family history prove that it is possible that retardation can be passed from a parent to his offspring, should a retarded person be prevented from marrying out of fear of propagating mental retardation within the community? Will society or his family be blameworthy if they prevent him from marrying?
  3. In the presence of assisted care and in the absence of any legal or medical objections, is a mentally retarded person permitted to marry?
